These Terms and Conditions ("Terms") apply to all orders placed through thomassuperstore.com ("the Website"), operated by Westerman ("the Entrepreneur", "we", "us"). By placing an order, you agree to these Terms.

Article 1 — Definitions

In these Terms, the following definitions apply:

  1. Entrepreneur: Westerman, the natural or legal person that offers products through Thomas Super Store.
  2. Consumer: A natural person who purchases products for personal, non-commercial use.
  3. Agreement: A distance contract between the Entrepreneur and the Consumer for the sale of products via the Website.
  4. Right of Withdrawal: The Consumer's right to cancel the Agreement within the cooling-off period.
  5. Cooling-off Period: The 14-day period during which the Consumer may exercise the Right of Withdrawal.
  6. Products: Physical goods offered for sale through the Website.
  7. Order: A request by the Consumer to purchase one or more Products via the Website.

Article 3 — Applicability

  1. These Terms apply to every offer made by the Entrepreneur and to every Agreement concluded between the Entrepreneur and the Consumer.
  2. Before the Agreement is concluded, these Terms are made available to the Consumer on the Website.
  3. The Entrepreneur reserves the right to amend these Terms. The most recent version is always available on the Website. Changes do not affect orders already placed.
  4. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.

Article 4 — Products and Prices

  1. All products on the Website are described as accurately as possible. Product images are for illustration purposes and may differ slightly from the actual product.
  2. All prices listed on the Website include VAT (BTW) and are displayed in Euros (€), unless stated otherwise.
  3. Shipping costs are not included in the product price and are displayed separately during the checkout process. See our Shipping & Returns page for details.
  4. The Entrepreneur reserves the right to change prices at any time. Price changes do not affect orders already confirmed.
  5. Obvious errors or mistakes in pricing do not bind the Entrepreneur. In such cases, the Entrepreneur will contact the Consumer to offer the correct price or cancel the order.
  6. Products are available while supplies last. If a product is out of stock after an order has been placed, the Entrepreneur will inform the Consumer and offer a refund or alternative product.

Article 5 — The Order Process

  1. An Agreement is concluded when the Consumer completes the checkout process and receives an order confirmation email from the Entrepreneur.
  2. The Consumer is responsible for providing accurate and complete information during checkout, including the correct shipping address and contact details.
  3. After placing an order, the Consumer receives an automatic order confirmation email. This email confirms that the order has been received, but does not yet constitute acceptance of the order.
  4. The Entrepreneur reserves the right to refuse or cancel an order in cases of suspected fraud, incorrect pricing, or if the product is unavailable.
  5. If an order is cancelled by the Entrepreneur, the Consumer will be notified and any payment already made will be refunded in full.

Article 6 — Right of Withdrawal

  1. The Consumer has the right to cancel the Agreement without giving a reason within 14 days after receiving the product (the Cooling-off Period).
  2. To exercise the Right of Withdrawal, the Consumer must inform the Entrepreneur of this decision by sending an unambiguous statement (e.g., an email to info@thomassuperstore.com) before the Cooling-off Period expires.
  3. During the Cooling-off Period, the Consumer shall handle the product and its packaging with care. The Consumer may unpack or use the product only to the extent necessary to assess the nature, characteristics, and functioning of the product, as they would in a physical store.
  4. The Consumer shall return the product without undue delay and in any event within 14 days of notifying the Entrepreneur of the withdrawal. The product must be returned in its original condition and packaging.
  5. The direct costs of returning the product are borne by the Consumer, unless the Entrepreneur has agreed to bear these costs or the product is defective.
  6. The Entrepreneur shall reimburse all payments received from the Consumer, including the standard delivery costs, within 14 days of receiving the returned product. The refund will be made using the same payment method used for the original transaction.

Exceptions to the Right of Withdrawal

The Right of Withdrawal does not apply to:

Article 7 — Payment

  1. Payment is due at the time of placing the order, unless otherwise agreed upon.
  2. The Consumer can pay using the following methods, processed securely through Mollie B.V.:
  1. The Consumer's payment data is processed securely by Mollie. The Entrepreneur does not store credit card numbers or other sensitive payment information on its servers.
  2. If the Consumer fails to meet their payment obligations, the Entrepreneur is entitled to charge reasonable costs incurred for collection.

Article 8 — Delivery

  1. The Entrepreneur shall use the utmost care when receiving and fulfilling orders.
  2. The place of delivery is the address provided by the Consumer during checkout.
  3. The Entrepreneur shall deliver accepted orders as soon as possible, but no later than 30 days after the order date, unless a different delivery period has been agreed upon.
  4. If delivery is delayed, the Consumer will be informed as soon as possible. In this case, the Consumer has the right to cancel the order and receive a full refund.
  5. The risk of damage or loss of products passes to the Consumer at the moment of delivery.
  6. Estimated delivery times are provided on the Shipping & Returns page. These are estimates and not guarantees.
  7. For international deliveries, any customs duties, import taxes, or other charges imposed by the destination country are the responsibility of the Consumer.

Article 9 — Warranty and Complaints

  1. All products sold through Thomas Super Store are authentic, officially licensed products. The Entrepreneur guarantees that the products conform to the Agreement and meet reasonable quality expectations.
  2. The Consumer is entitled to the legal warranty as provided by Dutch and European consumer protection law. This means that the product must be fit for its intended purpose and free from defects at the time of delivery.
  3. If a product is defective or does not match the description, the Consumer should contact the Entrepreneur within a reasonable time (within 2 months of discovering the defect) at info@thomassuperstore.com.
  4. The Entrepreneur will assess the complaint and, if justified, offer a repair, replacement, or refund at no additional cost to the Consumer.
  5. The Entrepreneur aims to handle all complaints within 14 days of receipt. If a longer processing time is needed, the Consumer will be informed of the expected timeline.

Article 10 — Liability

  1. The Entrepreneur's liability is limited to the amount covered by its business liability insurance or, if no insurance applies, to the invoice value of the product(s) in question.
  2. The Entrepreneur is not liable for indirect damages, including but not limited to consequential damages, lost profits, or damages resulting from personal injury.
  3. The limitations of liability in this Article do not apply if the damage is the result of intentional misconduct or gross negligence by the Entrepreneur.
  4. The Entrepreneur is not responsible for the content of third-party websites linked from the Website.

Article 11 — Intellectual Property

  1. All content on the Website, including text, images, logos, design, and software, is the property of Westerman or its licensors and is protected by copyright and other intellectual property laws.
  2. The Consumer may not reproduce, distribute, or use any content from the Website without the prior written consent of the Entrepreneur.
  3. Thomas & Friends, the Thomas & Friends logo, and all related character names and likenesses are trademarks of their respective owners. Thomas Super Store is an independent retailer and is not affiliated with or endorsed by the trademark holders.

Article 12 — Force Majeure

  1. The Entrepreneur is not obligated to fulfil any obligation if prevented from doing so by circumstances beyond its reasonable control (force majeure).
  2. Force majeure includes, but is not limited to: natural disasters, pandemics, government restrictions, transport disruptions, supplier failures, power outages, and cyberattacks.
  3. If force majeure persists for more than 60 days, either party may terminate the Agreement. In such cases, the Consumer will receive a full refund for any undelivered products.

Article 13 — Applicable Law and Disputes

  1. These Terms and any Agreements between the Entrepreneur and the Consumer are governed by Dutch law.
  2. In the event of a dispute, the parties shall first attempt to resolve the matter amicably through direct communication.
  3. If a dispute cannot be resolved amicably, it shall be submitted to the competent court in the Netherlands.
  4. EU consumers may also submit complaints via the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

Article 14 — Miscellaneous

  1. The Entrepreneur reserves the right to amend these Terms. Changes will be published on the Website and take effect 30 days after publication. Changes do not affect existing Agreements.
  2. If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  3. The Entrepreneur's failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
