These Terms and Conditions ("Terms") apply to consumer orders placed through thomassuperstore.com ("the Website"), operated by Westerman (WETO Media) ("the Entrepreneur", "we", "us"). Before placing an order, the Consumer is asked to read and accept these Terms.

Article 1 — Definitions

In these Terms, the following definitions apply:

  1. Entrepreneur: Westerman, the natural or legal person that offers products through Thomas Super Store.
  2. Consumer: A natural person who purchases products for personal, non-commercial use.
  3. Agreement: A distance contract between the Entrepreneur and the Consumer for the sale of products via the Website.
  4. Right of Withdrawal: The Consumer's right to cancel the Agreement within the cooling-off period.
  5. Cooling-off Period: The 14-day period during which the Consumer may exercise the Right of Withdrawal.
  6. Products: Physical goods offered for sale through the Website.
  7. Order: A request by the Consumer to purchase one or more Products via the Website.

Article 3 — Applicability

  1. These Terms apply to every offer made by the Entrepreneur and to every Agreement concluded between the Entrepreneur and the Consumer.
  2. Before the Agreement is concluded, these Terms are made available to the Consumer on the Website.
  3. The Entrepreneur reserves the right to amend these Terms. The most recent version is always available on the Website. Changes do not affect orders already placed.
  4. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.

Article 4 — Products and Prices

  1. All products on the Website are described as accurately as possible. Product images are for illustration purposes and may differ slightly from the actual product.
  2. EUR is the contractual price, payment and invoice currency. Where the Website also shows GBP, USD or another local currency, that amount is an indicative conversion based on the latest available European Central Bank reference rate. The Consumer's bank or payment provider may use a different rate or charge its own conversion fee.
  3. Product prices include the consumption tax that the checkout identifies as applicable to the sale. Shipping and any mandatory destination charge are shown before the Order is placed. For a checkout-enabled DDP destination, the confirmed total includes mandatory import duties and clearance charges so that no mandatory customs bill is due from the Consumer on delivery.
  4. The Entrepreneur reserves the right to change prices at any time. Price changes do not affect orders already confirmed.
  5. Obvious errors or mistakes in pricing do not bind the Entrepreneur. In such cases, the Entrepreneur will contact the Consumer to offer the correct price or cancel the order.
  6. Products are available while supplies last. If a product is out of stock after an order has been placed, the Entrepreneur will inform the Consumer and offer a refund or alternative product.

Article 5 — The Order Process

  1. Submitting an Order is an offer by the Consumer to buy the selected Products. An Agreement is concluded when the Entrepreneur explicitly accepts that Order by email.
  2. The Consumer is responsible for providing accurate and complete information during checkout, including the correct shipping address and contact details.
  3. A purely technical receipt or payment confirmation only confirms receipt and does not by itself constitute acceptance. The acceptance email may be combined with the dispatch confirmation.
  4. The Entrepreneur reserves the right to refuse or cancel an order in cases of suspected fraud, incorrect pricing, or if the product is unavailable.
  5. If an order is cancelled by the Entrepreneur, the Consumer will be notified and any payment already made will be refunded in full.

Article 6 — Right of Withdrawal

  1. The Consumer has the right to cancel the Agreement without giving a reason within 14 days after receiving the product (the Cooling-off Period).
  2. To exercise the Right of Withdrawal, the Consumer must inform the Entrepreneur of this decision by sending an unambiguous statement (e.g., an email to info@thomassuperstore.com) before the Cooling-off Period expires.
  3. During the Cooling-off Period, the Consumer shall handle the product and its packaging with care. The Consumer may unpack or use the product only to the extent necessary to assess the nature, characteristics, and functioning of the product, as they would in a physical store.
  4. The Consumer shall return the product without undue delay and in any event within 14 days after notifying the Entrepreneur of the withdrawal. The product must be complete and safely packed; the original packaging should be used if reasonably possible but is not a condition for exercising the Right of Withdrawal.
  5. The direct costs of a change-of-mind return are borne by the Consumer because this is disclosed before purchase. The Entrepreneur bears the necessary return costs if the product is defective, damaged or incorrect.
  6. The Consumer is only responsible for a reduction in value caused by handling beyond what was necessary to establish the nature, characteristics and functioning of the product.
  7. The Entrepreneur shall reimburse all payments received for the withdrawn purchase, including the cost of the least expensive standard outbound delivery offered, without undue delay and no later than 14 days after the withdrawal notice. The Entrepreneur may withhold reimbursement until the goods are received or the Consumer supplies evidence of return, whichever occurs first.
  8. The refund is made using the same payment method used for the original transaction, unless the Consumer expressly agrees otherwise, and without a refund fee.

Exceptions to the Right of Withdrawal

The Right of Withdrawal does not apply to:

Article 7 — Payment

  1. Payment is due at the time of placing the order, unless otherwise agreed upon.
  2. The Consumer can pay using the following methods, processed securely through Mollie B.V.:
  1. Available payment methods may vary by shipping country and by Mollie's current availability for that country.
  2. Payment is collected and the invoice is issued in EUR, including where the Website displays an indicative GBP or USD equivalent.
  3. The Consumer's payment data is processed securely by Mollie. The Entrepreneur does not store credit card numbers or other sensitive payment information on its servers.
  4. If the Consumer fails to meet their payment obligations, the Entrepreneur is entitled to charge reasonable costs incurred for collection.

Article 8 — Delivery

  1. The Entrepreneur shall use the utmost care when receiving and fulfilling orders.
  2. The place of delivery is the address provided by the Consumer during checkout.
  3. The Entrepreneur shall deliver accepted orders as soon as possible, but no later than 30 days after the order date, unless a different delivery period has been agreed upon.
  4. If delivery is delayed, the Consumer will be informed as soon as possible. In this case, the Consumer has the right to cancel the order and receive a full refund.
  5. The risk of damage or loss remains with the Entrepreneur until the Consumer, or a third party designated by the Consumer other than the carrier, physically receives the products.
  6. Estimated delivery times are provided on the Shipping & Returns page. These are estimates and not guarantees.
  7. No customs duties apply to ordinary deliveries within the EU customs territory. A destination outside that territory can accept an Order only when the checkout confirms it is available and states the applicable treatment. Great Britain and United States orders, when enabled, are offered DDP: Thomas Super Store arranges and bears mandatory import duty and clearance charges included in the confirmed total. This does not cover an optional service requested separately by the Consumer or a charge caused by incorrect information supplied by the Consumer.
  8. For the first Great Britain release, delivery is limited to England, Scotland and Wales; Northern Ireland, Jersey, Guernsey and the Isle of Man are excluded. For the first United States release, delivery is limited to the 50 states and District of Columbia; territories and APO/FPO/DPO addresses are excluded.

Article 9 — Warranty and Complaints

  1. All products sold through Thomas Super Store are authentic, officially licensed products. The Entrepreneur guarantees that the products conform to the Agreement and meet reasonable quality expectations.
  2. The Consumer is entitled to the legal warranty as provided by Dutch and European consumer protection law. This means that the product must be fit for its intended purpose and free from defects at the time of delivery.
  3. If a product is defective or does not match the description, the Consumer should contact the Entrepreneur promptly after discovering the defect at info@thomassuperstore.com. A late notification does not remove mandatory statutory rights where the law provides otherwise.
  4. The Entrepreneur will assess the complaint and, if justified, offer a repair, replacement, or refund at no additional cost to the Consumer.
  5. The Entrepreneur aims to handle all complaints within 14 days of receipt. If a longer processing time is needed, the Consumer will be informed of the expected timeline.

Article 10 — Liability

  1. The Entrepreneur is liable in accordance with applicable law.
  2. Nothing in these Terms excludes or limits mandatory consumer rights or liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, product liability, fraud, intentional misconduct or gross negligence.
  3. Links to third-party websites are provided for convenience. This does not exclude any statutory duty of care or liability that applies to the Entrepreneur.

Article 11 — Intellectual Property

  1. All content on the Website, including text, images, logos, design, and software, is the property of Westerman or its licensors and is protected by copyright and other intellectual property laws.
  2. The Consumer may not reproduce, distribute, or use any content from the Website without the prior written consent of the Entrepreneur.
  3. Thomas the Tank Engine & Friends and Thomas & Friends are trademarks of Gullane (Thomas) Limited. Thomas & Friends characters, logos and series artwork are © Gullane (Thomas) Limited, HIT Entertainment Limited and/or Mattel, as applicable. Thomas Super Store is an independent retailer and is not affiliated with, authorized by, sponsored by or endorsed by Mattel, Inc., HIT Entertainment Limited, Gullane (Thomas) Limited or any other rights holder.

Article 12 — Force Majeure

  1. The Entrepreneur is not obligated to fulfil any obligation if prevented from doing so by circumstances beyond its reasonable control (force majeure).
  2. Force majeure includes, but is not limited to: natural disasters, pandemics, government restrictions, transport disruptions, supplier failures, power outages, and cyberattacks.
  3. If force majeure persists for more than 60 days, either party may terminate the Agreement. In such cases, the Consumer will receive a full refund for any undelivered products.

Article 13 — Applicable Law and Disputes

  1. These Terms and any Agreements between the Entrepreneur and the Consumer are governed by Dutch law. This choice does not deprive a Consumer of mandatory protections provided by the law of the country in which the Consumer habitually resides.
  2. In the event of a dispute, the parties shall first attempt to resolve the matter amicably through direct communication.
  3. If a dispute cannot be resolved amicably, it may be submitted to a court that has jurisdiction under applicable mandatory consumer and procedural law.
  4. EU consumers can find information about recognised dispute-resolution bodies through the European Commission consumer-redress portal or contact their local European Consumer Centre. The former EU ODR platform was discontinued on 20 July 2025.

Article 14 — Miscellaneous

  1. The Entrepreneur may amend these Terms for future Agreements. The version accepted when an Order was placed continues to govern that Agreement unless a mandatory legal change requires otherwise.
  2. If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  3. The Entrepreneur's failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
  4. Google Maps review content, when displayed, remains subject to the Google Terms of Service and applicable Google contribution policies. Review invitations are optional and are not tied to a prize, discount or guaranteed publication.

Article 15 — Sodor Points

  1. Participation: Sodor Points is a free, voluntary loyalty programme for registered personal customer accounts. Points are personal, have no cash value, cannot be sold or transferred, and may not be combined between accounts.
  2. Earning: Eligible purchases earn 12 points per €1 on the product subtotal after discounts. Shipping and gift-wrapping charges do not earn points. After successful payment the points remain pending until 30 days after complete delivery, provided no cancellation, chargeback or open return applies.
  3. Previous orders: A customer may securely link eligible paid live orders placed up to 180 days before account creation by using the same customer email address and confirming an order number and delivery postcode. Returns, refunds, chargebacks, cancellations, delivery status and the 30-day return buffer remain fully applicable. A maximum of 20 orders can be linked automatically.
  4. Newsletter and social missions: Newsletter consent is optional and can be withdrawn at any time without losing points already validly earned. Social missions reward discovering the linked Thomas Super Store channel; following, subscribing or posting is not required.
  5. Friend referrals: Referral rewards apply only when the friend is a genuinely new customer, uses the personal referral link, meets the stated action or qualifying first-order threshold, and completes payment. Limits shown in the account apply. Self-referrals, duplicate accounts, automated activity and other abuse do not qualify.
  6. Validity: Earned points expire 18 months after the date they are credited. The account shows the next known expiry. Expired points cannot be reinstated except where an error by the Entrepreneur caused the expiry.
  7. Rewards: Rewards are guaranteed exchanges, not lotteries. A reward can be claimed once the required points are available. Physical rewards are subject to an availability check and are normally included free of charge with the customer's next paid order. A claimed reward that has not yet been sent waits until any points deficit caused by a later return has been settled. If the selected reward becomes unavailable after a valid claim, the Entrepreneur will offer a reasonable equivalent or restore all points used for that claim.
  8. Returns and reversals: Cancellation, refund, chargeback or return of a qualifying purchase causes the corresponding purchase points to be reversed in proportion to the refunded eligible product amount. Refunded shipping, gift-wrapping or other amounts that did not earn points do not cause a points reversal. If this makes a referral order fall below its qualifying threshold, the related referral bonuses are also reversed. If points have already been spent, future earnings first settle the resulting points deficit. This does not limit any statutory cancellation, warranty or refund right.
  9. Changes and closure: The Entrepreneur may change or end the programme for legitimate operational, legal or economic reasons. Material changes will be announced reasonably in advance through the Website or account where practical. Existing valid claims will be honoured and customers will receive a reasonable opportunity to use an existing positive balance, unless immediate action is required to prevent fraud or comply with law.
